A federal judge in Idaho ruled that a public charter school violated the rights of the first amendment to the church when it canceled a lease with which the church could preserve Sunday services In his gymnasium.

The decision of Chief US District Court Judge David Nye came in response to a lawsuit that focused on a lease between Truth Family Bible Church and Sage International, a charter school with a campus in Middleton, according to Idaho Education News.

The website reported that when the lease was canceled last year, Sage International signed up for around $ 15 million in bonds to finance the upgrades of construction via the Idaho Housing and Finance Association (IHFA). Lawyers for the Binding Authority of the State then marked the lease of the church as a potential infringement of the Blaine -Amendment of Idaho, which blocks religious organizations to receive tax money, it added.

NYE reportedly wrote in his statement that concern was a ‘judgment in the judgment’, as Truth Family Bible Church would have ‘only occasionally benefited from the improved facilities of the bond’, without funds being given directly to them.

“The motivations of IHFA and Sage to terminate the lease of Truth Family, or reasonable or not, was still a violation of the constitutional rights of the Truth Family,” Nye also said, according to Idaho Education News.

The website said that a lawyer who represents the church argued that the use of the Blaine amendment to terminate the lease, the free exercise, location and freedom of expression of the first amendment ran.

Nye agreed with each of the First amendment Claims, who write in his statement that the movement to cancel the lease of the church “his religious speech” effectively oppressed “, Idaho Education News reported.

“We are happy with this outcome,” said Idaho -Procurer -General Raúl Labrador, whose office intervened in the case, to Idaho Education News through a spokesperson. “Government agencies cannot discriminate religious organizations, simply because they are religious. Truth Family Bible Church earned the same treatment as every secular group, and we are happy that the court has recognized this.”
