Arkansas Social Media Age Verification Law Blocked by Federal Judge

An Arkansas law that requires social media companies to verify the ages of their users By a federal judge who ruled that it was unconstitutional. The decision is an important victory for social media companies and digital rights groups that have opposed the law and others like this.

Arkansas became the second state (after utah) that one Age verification Social media law . The Social Media Safety Act required companies to verify user games under the age of 18 and to get permission from their parents. The law was challenged by Netchoice, a lobbying group that represents the technical industry whose membership Meta, Snap, X, Reddit and YouTube includes. Netchoice has also challenged laws that limit access to social media And .

In Judge Timothy Brooks said that the law, known as ACT 689, was too broad. “ACT 689 is a content -based restriction on speech, and it is not the target to tackle the damage that the State has identified,” Brooks wrote in his decision. “Arkansas takes an ax for the protected speech of adults and minors, although the Constitution requires it to use a scalpel.” Brooks also emphasized the “unconstitutional vague” applicability of the law, which apparently created obligations for some online services, but may have exempt services that had the “dominant or exclusive function [of]… direct messages “such as Snapchat.

“The court confirms what we have argued from the start: laws that limit access to protected speech violates the first amendment,” said Chris Marchese of Netchoice in a statement. “This statement protects Americans against the handing over of their IDs or biometric data only to gain access to constitutionally protected speech online.”

It is not clear whether government officials in Arkansas will appeal against the ruling. “I respect the court’s decision and we evaluate our options,” said Attorney -General Tim Griffin in Arkansas in a statement.

Even with the newest victory from Netchoice, it seems that the age verification laws will probably not disappear quickly. Utah recently adopted a requirement for age verification . And Requiring porn sites to perform age verification is currently in front of the Supreme Court.
