In Judge Timothy Brooks said that the law, known as ACT 689, was too broad. “ACT 689 is a content -based restriction on speech, and it is not the target to tackle the damage that the State has identified,” Brooks wrote in his decision. “Arkansas takes an ax for the protected speech of adults and minors, although the Constitution requires it to use a scalpel.” Brooks also emphasized the “unconstitutional vague” applicability of the law, which apparently created obligations for some online services, but may have exempt services that had the “dominant or exclusive function [of]… direct messages “such as Snapchat.
“The court confirms what we have argued from the start: laws that limit access to protected speech violates the first amendment,” said Chris Marchese of Netchoice in a statement. “This statement protects Americans against the handing over of their IDs or biometric data only to gain access to constitutionally protected speech online.”
It is not clear whether government officials in Arkansas will appeal against the ruling. “I respect the court’s decision and we evaluate our options,” said Attorney -General Tim Griffin in Arkansas in a statement.
Even with the newest victory from Netchoice, it seems that the age verification laws will probably not disappear quickly. Utah recently adopted a requirement for age verification . And Requiring porn sites to perform age verification is currently in front of the Supreme Court.
